Westmore Brazilian Jiu Jitsu Waiver and Membership Agreement

1. I understand that the sport of Brazilian Jiu-Jitsu, along with other fitness and recreational activities, including practices, clinics, seminars, and other special events (collectively referred to as “the sport”), can be dangerous and involve the risks of injury and death. I understand that these risks include, but are not limited to, loss of control, use of training facilities, exercise programs, areas designated as “hotspots,” and any information construed as advice. Despite the risks involved in the sport and in consideration of being allowed to participate in the sport, I AGREE TO EXPRESSLY ASSUME ALL RISKS OF INJURY OR DEATH that might be associated with the sport and the use of the facilities of Westmore Brazilian Jiu Jitsu, including, but not limited to, the use of equipment, mat areas, caged areas, locker rooms, and participation in instruction, special events, and participating in the sport beyond the supervised area (collectively referred to as “use of the facilities”).

2. Furthermore, to the fullest extent allowed by law, I agree never to sue and to release from liability, Westmore Brazilian Jiu Jitsu, LLC, its owners, employees, agents, contractors, landowners, sponsors, and affiliated companies (referred to as “Westmore Brazilian Jiu Jitsu”) for any damage, injury, or death to me arising from participation in the sport or use of the facilities, regardless of cause, including the NEGLIGENCE of Westmore Brazilian Jiu Jitsu.

3. I certify that I am in good health and have no physical condition that would prevent participation in the sport or put me at greater risk for injury. I agree that all activities undertaken at Westmore Brazilian Jiu Jitsu are conducted at my own risk. Furthermore, I agree to use my personal medical insurance as the sole medical coverage payment if accident or injury occurs. I consent to emergency medical treatment in the event such care is required. Knowing and understanding the risks involved with the participation in the sport, I hereby voluntarily and willingly assume responsibility for all risks and dangers associated with my participation in the sport.

4. I understand this is a release of liability that is valid FOREVER. I understand that this Release of Liability will prevent me or my heirs from filing suit or making any claim for damages in the event of injury or death to me arising out of participation in the sport or use of the facilities. Additionally, in the event I, my heirs, the user, my legal representative, or any other person acting on my behalf files a lawsuit arising out of my participation in the sport or use of the facilities, I agree to defend, indemnify, and hold harmless Westmore Brazilian Jiu Jitsu for any damages, attorneys’ fees, or costs associated with or arising out of such a lawsuit.

5. With a complete and full understanding of this release of liability and express assumption of risk agreement, I nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon me, my heirs, assigns, legal representatives, and any other person acting on my behalf. I also agree to indemnify Westmore Brazilian Jiu Jitsu for any and all claims brought by a third party which arise from the participant’s or my participation in the sport.

6. Media Release: I grant exclusive permission to Westmore Brazilian Jiu Jitsu to use my name, likeness, and photograph for the purpose of publicity, public relations, editorial, or other advertising purposes without restriction as to frequency or duration.

Membership Term: Your initial membership term is for one year. After the first year, the membership will automatically renew for another year unless you specifically request to change to a month-to-month plan. You will be reminded of the upcoming renewal no less than 30 days and no more than 60 days before the end of the initial term.

Automatic Payments: Your membership fees will be automatically withdrawn from your payment card on a monthly basis.

Cooling-Off Period:

• For Kids BJJ ($1200/year or $100/month): You have the right to cancel this contract within 5 business days from the date of signing for a full refund.
• For Adult BJJ ($1560/year or $130/month): You have the right to cancel this contract within 20 days from the date of signing for a full refund.

Additional Cancellation Rights:
You may cancel if you become disabled, die, or move more than 25 miles from the facility.
You may cancel if the facilities or services are substantially reduced or eliminated, unless disclosed in the contract.
You may cancel if induced to sign the contract by willfully false or misleading information.

Facility Availability and Operating Hours:
Westmore Brazilian Jiu Jitsu is located at 239 W. Tefft, Nipomo, CA 93444. The operating hours are as follows:

• Sunday: 12:30 PM – 2:00 PM
• Monday: 12:00 PM – 1:15 PM, 6:00 PM – 7:15 PM
• Tuesday: 4:00 PM – 7:15 PM
• Wednesday: 12:00 PM – 1:15 PM, 6:00 PM – 7:15 PM
• Thursday: 4:00 PM – 7:15 PM
• Friday: 9:00 AM – 10:00 AM, 12:00 PM – 1:15 PM, 6:00 PM – 7:15 PM
• Saturday: 6:00 PM – 7:30 PM

Services and Access:
All classes requiring an instructor will provide expert-led instruction in Brazilian Jiu Jitsu. Brazilian Jiu Jitsu as a martial art should be practiced in a safe setting under the guidance of qualified individuals. Members will have access to any class in accordance with their selected membership. Classes for children and adults will be specified respectively.

To cancel your membership within the cooling-off period, please mail or deliver a signed and dated notice, or send a telegram which states that you, the buyer, are canceling the agreement, or words of similar effect. The notice shall be sent to Westmore Brazilian Jiu Jitsu at 208 E. Creston St., Santa Maria, CA 93444. Alternatively, you can email your cancellation notice to manny@westmorebjj.com.
